HTS Codes Published for Section 301 Tariff Increase

May 22, 2024
By: Chaney A. Finn

We have recently reported that the United States Trade Representative’s office released its four-year review of the Section 301 duties imposed on products of China, concluding that China has not eliminated its technology transfer related acts, policies, and practices, which continue to impose a burden or restriction on U.S. commerce. This conclusion has resulted in the continuance of the duties with some even being increased. The review was subject to substantial Congressional pressure and elevated interest from the importing community.

The Office of U.S. Trade Representative only previously published categories of which products were subject to the tariff increase and has since published a notice with 382 Harmonized Tariff Schedule (HTS) subheadings and five statistical reporting numbers subject to the increase.

Comments on the specified tariff hikes are due by June 28, 2024, and may begin being submitted on May 29, 2024. Exclusions are currently limited to certain machinery used to make solar products and various other products which are effective through May 31, 2025.
